Nautical Nomads (“Nautical Nomads,” “we,” “us,” “our”) respects your privacy. This Privacy Policy describes how we collect, use, share, and protect personal information when you visit our website, shop in our online store, or book our photography and scuba services (the “Services”). By using the Services, you agree to this Privacy Policy.

1. Who we are and how we operate

  • U.S. based controller. Nautical Nomads is the controller for personal information we collect directly from you.

  • Wix platform. Our website and store are hosted on Wix. Wix provides hosting, site features, checkout tools, analytics, and certain app integrations.

  • Printful fulfillment. We use Printful to make and ship merchandise you order. Printful processes order and shipping data to fulfill your purchase.

  • Other providers. We also use payment processors, booking and waiver tools, gallery delivery tools, email and SMS providers, analytics, advertising, shipping carriers, and professional advisors. These parties act as our processors or service providers and handle data under our instructions.

2. Information we collect

What we collect depends on how you interact with us.

a. Identifiers and contact details
Name, email, phone, billing and shipping address, account credentials if you register.

b. Orders and bookings
Items purchased, cart contents, order history, booking date and time, location preferences, project notes, scuba certification level that you choose to provide, emergency contact for activities where required, signed waivers and releases.

c. Payments
Payment card data is collected and processed by our payment processors, such as Wix Payments, Stripe, or PayPal. We do not store full card numbers.

d. User content and communications
Inquiries, emails, messages, reviews, survey responses, testimonials, images or media that you upload or send to us, and preferences you share.

e. Device and usage data
IP address, device and browser type, operating system, cookie identifiers, pages viewed, actions on the site, referral URLs, dates and times, email engagement.

f. Location data
Approximate location from IP or shipping address for fraud prevention, shipping and tax calculation, and content localization.

g. Photos, likeness, and deliverables
For photography clients, we process images captured during your session and any chosen deliverables to edit, host, and deliver galleries.

h. Sensitive information used only when needed
If you choose to provide health or fitness information related to scuba eligibility, we use it only to assess participation requirements, manage safety and risk, comply with law, and provide the requested service. Do not send medical information we did not request.

We may also receive information from service providers, anti fraud partners, analytics and advertising partners, social platforms you connect with, and publicly available sources.

3. How we use information

  • Provide and improve the Services, including orders, fulfillment, bookings, editing and delivering photo galleries, and customer support.

  • Verify eligibility for certain activities, confirm scuba certification level, collect and manage required waivers and releases.

  • Communicate with you about orders, bookings, galleries, account notices, and support.

  • Personalize site content and measure performance and traffic.

  • Send marketing emails or SMS with your consent where required. You can opt out at any time.

  • Detect, investigate, and prevent fraud or security incidents.

  • Comply with legal, tax, accounting, and recordkeeping obligations, manage disputes, and enforce our terms.

4. Cookies and similar technologies

We and our providers use cookies, pixels, and similar tools to run the site, keep carts and bookings working, remember preferences, analyze traffic, and show or measure advertising. You can control cookies in your browser settings. Some browsers support a Global Privacy Control signal. Where required by law, we treat a valid GPC signal as a request to opt out of targeted advertising or sharing for cross context behavioral advertising.

5. How we share information

We do not sell your personal information for money. We share data as needed with:

  • Wix and integrated apps for hosting, site features, analytics, and checkout.

  • Printful for product manufacturing and shipping.

  • Payment processors for secure payments and fraud checks.

  • Booking, waiver, and gallery providers to schedule, collect signatures, deliver galleries, and manage files.

  • Email and SMS providers to send messages you request or allow.

  • Analytics and advertising partners to understand site use and, where permitted, to deliver or measure ads.

  • Contracted photographers or dive professionals to fulfill your booking, with only the information necessary.

  • Shipping and logistics to deliver products.

  • Professional advisors and legal authorities to comply with law or protect rights.

  • Business transactions in case of a merger, sale, financing, or acquisition.
    We may share aggregated or de identified information that does not identify you.

6. Your choices

  • Marketing emails and SMS. Unsubscribe anytime using the link in communications or by contacting us. Transactional messages cannot be opted out of.

  • Targeted advertising and sharing. Use browser or device settings and industry tools to limit targeted advertising. If we provide a “Do Not Sell or Share My Personal Information” link, you can use it and we honor GPC where required.

  • Account information. If you create an account, you can review and update certain details in account settings.

  • Cookies. Block or delete cookies in your browser. Some features may not work without them.

7. Data retention

We keep personal information only as long as needed for the purposes above or as required by law. Examples include:

  • Orders and bookings kept for tax, accounting, and compliance.

  • Waivers, releases, and safety records kept as required by law and for risk management.

  • Client galleries retained according to our delivery terms or your contract, then archived or deleted under our policy.

  • Marketing data kept until you opt out or until it is no longer needed.
    When information is no longer needed, we delete or de identify it according to our retention rules and applicable law.

8. Data security

We use administrative, technical, and physical safeguards designed to protect personal information, such as secure hosting, access controls, and encryption by payment processors. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children’s privacy

Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. For sessions that involve minors, a parent or legal guardian must provide required information and consent.

10. International visitors

We are based in the United States. If you access the Services from outside the United States, your information may be transferred to and processed in countries with different data protection laws. By using the Services, you consent to these transfers.

11. Your privacy rights by region

California residents
You may have the right to know, access specific pieces, correct, delete, and to opt out of selling or sharing personal information for cross context behavioral advertising. We do not sell personal information for money. To submit a request or to use the Do Not Sell or Share option, contact us at the details below or use any request forms provided on our site. We will not discriminate against you for exercising your rights.

Other U.S. state laws
Residents of states with privacy laws such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, and Delaware may have rights to access, correct, delete, opt out of targeted advertising, opt out of sales, opt out of certain profiling, obtain a portable copy of data provided by you, and appeal a decision. EEA and UK
You may have rights to access, rectification, erasure, restriction, objection, and portability, and to withdraw consent where processing is based on consent. Our legal bases include consent, contract performance, legitimate interests, and legal obligations. For transfers outside the EEA or UK, we use appropriate safeguards such as Standard Contractual Clauses.

12. How to exercise your rights

If permitted by law, you may designate an authorized agent. We will respond within the timelines required by applicable law. If your request is denied, you may have a right to appeal. Instructions will be included in our response.

13. Photos, likeness, model releases, and marketing use

  • We process images captured during sessions to edit, proof, and deliver galleries.

  • We do not use your images in our marketing unless you grant permission in a release, contract, or settings you control. You can withdraw future permission where permitted by law, but this does not affect prior uses already made in reliance on your consent.

  • If your booking includes other participants, you are responsible for ensuring they understand and agree to any required releases.

14. Activities, safety information, and waivers

For dive and water activities, you may be asked to provide scuba certification level and to review and sign a waiver. Any health information you choose to provide is used only for eligibility, safety, legal compliance, and risk management. We do not use such information for marketing.

15. Third party sites and integrations

Our site may link to or integrate third party services, such as Wix apps, Printful, payment processors, booking and waiver tools, gallery providers, social media, analytics, and advertising platforms. These parties have their own privacy policies. Review their policies before providing information to them.

16. Changes to this policy

We may update this Privacy Policy from time to time. The “Last Updated” date will reflect the latest version. Your continued use of the Services after changes means you accept the updated policy.
