1. Eligibility to Purchase

By using this Site and placing an order, you represent and warrant that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. This Agreement constitutes the entire contract between you and Nautical Nomads. Continued use of the Site or placing an order after changes constitutes acceptance.

 

3. Orders, Payment & Processing

• Payment Processing: All payments are securely processed through our third-party PCI-DSS-compliant payment processor. By placing an order, you authorize us (through the payment processor) to charge your selected payment method.

• Pricing & Currency: All prices are listed in U.S. Dollars (USD) unless stated otherwise. Customers are responsible for any applicable taxes, duties, or fees.

• Order Acceptance: We reserve the right to accept or refuse any order at our sole discretion, including in cases of suspected fraud, incorrect pricing, or product unavailability.

• Errors: In the event of typographical, pricing, or other errors, we reserve the right to correct such errors and cancel or adjust affected orders, with notice and refund where applicable.

 

4. Shipping, Risk of Loss & Delivery

• Orders are shipped directly from our print and fulfillment partners. Delivery times vary based on location and carrier.

• Risk of loss or damage passes to you once the order is delivered to the carrier. Claims for lost or delayed packages must be submitted within 30 days of the estimated delivery date.

• We cannot guarantee delivery to P.O. boxes, military APO/FPO addresses, or restricted locations.

 

5. Returns & Refunds

• Made-to-Order: All products are custom-made to order. Except as set out below, we do not accept returns or cancellations.

• Defective or Damaged Items: If your product arrives defective, damaged, or not as described, you may request a replacement or refund within 30 days of receipt. Proof (such as photos) may be required.

• Lost Packages: Claims for packages lost in transit must be submitted within 30 days after the estimated delivery date.

• Non-Returnable Items: For health and hygiene reasons, face masks and other sealed personal-use products cannot be returned once opened.

• Discretionary Returns: Size exchanges, buyer’s remorse, or discretionary returns are not covered. If accepted, such returns are at your expense.

All products and services are provided “as is” and without warranties of any kind, express or implied. Nautical Nomads makes no representations or guarantees regarding uninterrupted service, error-free operation, or product performance. Some jurisdictions may not allow limitations on implied warranties, so these exclusions may not apply to you.

 

7. Limitation of Liability

To the fullest extent permitted by law:

• Nautical Nomads and its partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your purchase or use of products/services.

• Our maximum liability for any claim related to your order shall not exceed the greater of: (i) $100 USD, or (ii) the total amount paid for the product/service in question.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Nautical Nomads, its affiliates, partners, and employees against any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

 

9. Termination

We may suspend or terminate your access to the Site or cancel orders if you breach these Terms, applicable law, or for any reason at our sole discretion. Termination does not affect accrued rights or obligations.

 

10. Governing Law
